&lt;P&gt;Okay, you've found the home of your dreams.&amp;nbsp; You've determined how much you can afford because you've already been pre-approved by your lender, and your offer has been accepted.&amp;nbsp; But wait.&amp;nbsp; If you're financing the purchase, like almost everyone does, you'll actually be paying more than the final sale price of the home.&lt;/P&gt;
&lt;P&gt;Many buyers don't stop to think about how much they'll really be paying for their home by the time they've reached the final payment.&amp;nbsp; It's worth considering, and it makes it evident that you should shop around and get the best loan terms possible.&lt;/P&gt;
&lt;P&gt;Be sure to discuss your options with a trusted local real estate agent, who can provide mortgage information, illustrate different financing options, and even recommend lenders suited to your needs.&amp;nbsp; With literally hundreds, if not thousands, of options available, it's helpful to begin with the basic facts to help you whittle down your choices.&lt;/P&gt;
&lt;P&gt;Determine how much is available for a down payment.&amp;nbsp; If you're putting up less than 20%, you'll need a guarantee that often comes in the form of PMI (private mortgage insurance).&amp;nbsp; This will add to the overall cost of your loan, at least until you've paid off a significant percentage.&amp;nbsp;&lt;/P&gt;
&lt;P&gt;Again, discuss your loan options with your real estate agent before you make any offers, in order to avoid unpleasant delays and unexpected expenses.&lt;/P&gt;

&lt;P&gt;&lt;STRONG&gt;GET SERIOUS!&lt;/STRONG&gt;&lt;/P&gt;
&lt;P&gt;Familiar with the law of supply and demand?&amp;nbsp; In real estate right now, it may seem like the supply of homes for sale is much greater than the numbers of buyers demanding those homes, forcing prices down and decreasing activity.&amp;nbsp; But what's really in shortage may be serious, legitimate sellers.&lt;/P&gt;
&lt;P&gt;A committed seller is willing and able to accept the best offer in the current market, and be motivated to do so.&amp;nbsp; Receiving a fair offer is inextricably connected to pricing your home fairly.&amp;nbsp; The best way to arrive at an attractive price is to aggressively challenge the competition.&amp;nbsp; Using past prices, your investment in the home, or even appraisals may not produce the ideal value factor for your home.&lt;/P&gt;
&lt;P&gt;If you're serious about selling, let an agent describe to you how an appropriately priced and aggressively marketed home will &lt;STRONG&gt;&lt;EM&gt;always&lt;/EM&gt;&lt;/STRONG&gt; generate interest and offers, and will ultimately sell for exactly what it's worth in the current market.&amp;nbsp; All other factors being equal, a home that languishes on the market is simply overpriced, and a seller willing to wait for more than fair price would be better served by waiting until the market catches up before entering the fray.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;Remember this Golden Rule: There is a buyer for everything.&amp;nbsp; Any home can be sold in any market when proper pricing is combined with effective marketing.&lt;/P&gt;

&lt;P class=dropcap&gt;Every community has hidden gems. Whether it’s a locals-only restaurant, a small park or community event, they are what make every community special.&lt;BR&gt;&lt;BR&gt;Usually they are small and out-of-the-way places. In this case, the hidden gem may be out-of-the-way, but at more than 100 acres it is not small. What I am talking about is the Mesa Verde Country Club, which turns 50 this January.&lt;BR&gt;&lt;BR&gt;Many of the non-golfers in the community confuse it with Costa Mesa Country Club, which is off of Mesa Verde East but just south of Adams Avenue. Mesa Verde Country Club is north of Adams just off Mesa Verde West. You can understand the confusion.&lt;BR&gt;&lt;BR&gt;The land where the golf course sits was sold in 1956 to investor Adolph Sleceta, who planned to work with the developers Ray Watt and Walter Gaynor to build more housing in Mesa Verde.&lt;BR&gt;&lt;BR&gt;Due to terrain and utility issues, however, they could not build homes. They instead decided to fund construction of a golf course and clubhouse. Not so good for them, but lucky for us.&lt;BR&gt;&lt;BR&gt;Over the years, the club passed though several corporate owners until 1975 when the members bought it from Japan Golf Promotion for a whopping $2.1 million. Today, even in a down market, many of the homes on the course sell for more than that.&lt;BR&gt;&lt;BR&gt;The golf course has a very rich history. It has been home to many PGA and LPGA tournaments. It hosted the first Orange County Open, a PGA Tour event in 1959 and continued that event until 1962. Starting in 1979 it hosted LPGA tour events for six consecutive years.&lt;BR&gt;&lt;BR&gt;This club rates high among golfers. Steve Rhorer, club vice president, avid golfer and Mesa Verde resident, joined in 2000. Prior to that, he had been a longtime member of the Virginia Country Club in Long Beach.&lt;BR&gt;&lt;BR&gt;“I have played every private course in the county and from a pure golfing standpoint; this course is second to none,” he told me. “You will use every club in your bag, and with the tree-lined fairways, you better be accurate.”&lt;BR&gt;&lt;BR&gt;More than 600 local families are associated with the club as golf, tennis or social members. Seventy percent of the families used to be from Costa Mesa. Now it is composed of almost equal parts Costa Mesa, Newport Beach and Huntington Beach residents.&lt;BR&gt;&lt;BR&gt;I talked with past board member Pete Daley, who joined in 1977. Daley, now residing in Aliso Viejo, lived on the bird streets for more than 20 years. He told me it is a very family-friendly club.&lt;BR&gt;&lt;BR&gt;“Our three kids went through all the swimming and tennis programs,” he said. “The club played a big role throughout their youth.”&lt;BR&gt;&lt;BR&gt;For the past 50 years, Mesa Verde Country Club has been one of those hidden gems that make up Costa Mesa and Newport Beach. It has not just been a place to play golf and tennis, but a place that makes you part of a community. &lt;P&gt;&amp;nbsp;Some financial experts have labeled 2007's market as the "roulette economy."&amp;nbsp; As we all know, whatever goes up must come down, but the nice thing about real estate is that whatever goes down always comes back upward again (much like stocks work).&lt;/P&gt;
&lt;P&gt;&amp;nbsp;A healthier market is anticipated in 2008, as Wall Street cleans up the lending mess and the pressure cooker of home demand releases its top.&amp;nbsp; While the national average of home prices declined between one and two percent in 2007, that's peanuts compared to how much homes appreciated in the previous years.&amp;nbsp; And many markets are appreciating still.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;Keep in mind that "national" statistics for real estate mean about as much as a forecasted high temperature for the entire nation.&amp;nbsp; Consumers get skittish when they hear that 40% of foreclosures are due to doubtful subprime loans, but it's important to put that in perspective, because those loans only constitute about 10% of all mortgages.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;As the lending industry stabilizes and interest rates rise only slightly, buyers who are ready to purchase will discover that housing is still the best investment out there.&amp;nbsp; Ask a real estate agent to monitor new listings, selling times and final sales prices, and then to advise you when conditions are right to either buy or sell.&amp;nbsp; 2008 should be a year of opportunity in the real estate industry.&lt;/P&gt;

&lt;P&gt;&amp;nbsp;Whether you are buying a home or selling one, it is likely that once an Offer To Purchase is on the table, you'll enter a phase of the transaction called Negotiation.&amp;nbsp; Fear not - this is how both sides "win."&amp;nbsp; By following a few reasonable recommendations, both parties can turn Negotiation into Agreement.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;It's best to begin with a fair asking price and a fair offer.&amp;nbsp; Sellers, don't shoot for the moon. Buyers, don't lowball on a home you really want.&amp;nbsp; Overpricing is a turnoff to potential buyers, while low offers may meet with outright rejection.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;Next, understand and respect each other's priorities. Seller won't budge on price?&amp;nbsp; Perhaps they would pay more of the transaction fees. Buyer urgently needs quick possession?&amp;nbsp; Perhaps they would forgo some repairs.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;This illustrates the value of compromise.&amp;nbsp; A win-win situation doesn't necessarily mean that both parties get everything they demand.&amp;nbsp; Avoid emotional decisions and be open to concessions.&amp;nbsp; If you can't agree on a particular term, try meeting in the middle.&amp;nbsp; Who will pay closing costs?&amp;nbsp; Who will pay for cosmetic repairs?&amp;nbsp; You needn't hold up the entire agreement when you can simply split the difference on certain terms and move forward.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;Experienced real estate professionals are successful negotiators.&amp;nbsp; Bringing buyers and sellers together is Job Number One.&amp;nbsp; Protect your best interests by seeking the advice of a professional.&lt;/P&gt;

&lt;P&gt;How much home can you afford?&amp;nbsp; How do you even begin to find the answer to that question?&amp;nbsp; You've probably heard terms like "pre-approval" and "pre-qualification" tossed around, but do you understand the critical difference between those two?&amp;nbsp; If your answer is "no," then please read on to avoid major disappointment when you make your offer.&lt;/P&gt;
&lt;P&gt;"Pre-qualification" is a fine place to start, but if you're really serious about the time and money you're going to invest in purchasing a home, you'll really want to focus on "pre-approval."&amp;nbsp; Approval, and not just qualification, is secured when you complete and submit a loan application, along with the appropriate documentation and fees.&lt;/P&gt;
&lt;P&gt;The lender will review your application and paperwork, and will notify you of just how much financing you can secure.&amp;nbsp; Only then will you have the confidence to make your home choice and make your offer.&amp;nbsp; &lt;/P&gt;
&lt;P&gt;A pre-qualification, on the other hand, is more informal, and only an estimate of the funds for which you might qualify after applying for a loan.&amp;nbsp; You might make an offer with pre-qualification in hand, but it's no guarantee that your loan application will be accepted.&lt;/P&gt;
&lt;P&gt;The seller's representative will have educated the seller about this critical difference, so make them an offer they can't refuse!&amp;nbsp; Pre-approval puts you in the driver's seat, so get ready to move!&lt;/P&gt;

&lt;P&gt;When you purchase an automobile, what's the first thing you take care of before driving around town? You've got to get insurance, of course. It's no different when you're ready to buy a home, but you have some more options.&lt;/P&gt;
&lt;P&gt;First, understand that there are four basic types of insurance, some required, some not. Title insurance protects you in the event that title to the property is found to be in question. You definitely want to purchase title insurance as part of the closing transaction.&lt;/P&gt;
&lt;P&gt;Homeowner's insurance provides coverage in cases of theft, damage and liability. Your lender will require this policy, so this is another absolute necessity.&lt;/P&gt;
&lt;P&gt;Flood insurance may be required, depending on the location of your new home. The federal government provides this policy to cover replacement value of the home and its contents. Consult with a local real estate agent to determine necessity and restrictions.&lt;/P&gt;
&lt;P&gt;Finally, a newer and very popular form of "insurance" is the home warranty, often provided by the seller as peace of mind for the buyer. &lt;/P&gt;
&lt;P&gt;These are often one-year policies that cover repairs to systems and appliances, and more details on this are coming up in my next column. In the meantime, consult with a real estate agent if you have any questions or concerns about any of the insurance policies addressed here.&lt;/P&gt;

&lt;P align=left&gt;A: The new laws take effect July 1, 2008 &lt;/P&gt;&lt;/FONT&gt;&lt;B&gt;&lt;FONT face="Times New Roman,Times New Roman"&gt;
&lt;P align=left&gt;Q: What is the difference between the two laws? &lt;/P&gt;&lt;/B&gt;&lt;/FONT&gt;&lt;FONT face="Times New Roman,Times New Roman"&gt;
&lt;P align=left&gt;A: The first prohibits all drivers from using a handheld wireless telephone while operating a motor vehicle. &lt;/FONT&gt;&lt;FONT face="Times New Roman,Times New Roman" size=3&gt;(Vehicle Code (VC) §23123). &lt;/FONT&gt;&lt;FONT face="Times New Roman,Times New Roman"&gt;Motorists 18 and over may use a hands-free device. &lt;P align=left&gt;A: The law allows a driver to use a wireless telephone to make emergency calls to a law enforcement agency, a medical provider, the fire department, or other emergency services agency. &lt;/P&gt;&lt;/FONT&gt;&lt;B&gt;&lt;FONT face="Times New Roman,Times New Roman"&gt;
&lt;P align=left&gt;Q: What are the fines if I’m convicted? &lt;/P&gt;&lt;/B&gt;&lt;/FONT&gt;&lt;FONT face="Times New Roman,Times New Roman"&gt;
&lt;P align=left&gt;A: The base fine for the FIRST offense is $20 and $50 for subsequent convictions. According to the Uniform Bail and Penalty Schedule, with the addition of penalty assessments, a first offense is $76 and a second offense is $190. &lt;/P&gt;&lt;/FONT&gt;&lt;B&gt;&lt;FONT face="Times New Roman,Times New Roman"&gt;

&lt;P align=left&gt;Q: What if my phone has a push-to-talk feature, can I use that? &lt;/P&gt;&lt;/B&gt;&lt;/FONT&gt;&lt;FONT face="Times New Roman,Times New Roman"&gt;
&lt;P align=left&gt;A: No. The law does provide an exception for those &lt;/FONT&gt;&lt;FONT face="Times New Roman,Times New Roman" size=3&gt;operating a commercial motor truck or truck tractor (excluding pickups), implements of husbandry, farm vehicle or tow truck, to use a two-way radio operated by a "push-to-talk" feature. &lt;/P&gt;&lt;/FONT&gt;&lt;B&gt;&lt;FONT face="Times New Roman,Times New Roman"&gt;

&lt;P align=left&gt;A: The law does not specifically prohibit that, but an officer can pull over and issue a citation to a driver of any age if, in the officer’s opinion, the driver was distracted and not operating the vehicle safely. Drivers under the age of 18 may not use a wireless telephone, pager, laptop or any other electronic communication or mobile services device to speak or text while driving in any manner, even hands free. Teen drivers are vulnerable to driving distractions such as talking with passengers, eating or drinking, and talking or texting on wireless phones, which increase the chance of getting involved in serious vehicle crashes. &lt;/P&gt;&lt;/FONT&gt;&lt;B&gt;&lt;FONT face="Times New Roman,Times New Roman"&gt;
&lt;P align=left&gt;Q: Can my parents give me permission to allow me to use my wireless telephone while driving? &lt;/P&gt;&lt;/B&gt;&lt;/FONT&gt;&lt;FONT face="Times New Roman,Times New Roman"&gt;
&lt;P align=left&gt;A: NO. &lt;P&gt;Get fully approved for a loan, have you letter in hand from the lender.&amp;nbsp; Get it to the agent you feel most comfortable with that has your best interests at heart. Start shopping!&amp;nbsp; Most bank owned homes that&amp;nbsp;are on the market are priced very aggressively will sell with 1 - 4 days of coming on the market.&amp;nbsp; Be prepared to get out and view on your lunch hour!&amp;nbsp; Waiting till after work could cost you $1,000's + most likely the home will be gone!&amp;nbsp; &lt;/P&gt;
&lt;P&gt;I recently sold a home that had 30 offers on it. It was offered about&amp;nbsp;$175,000 below the last sale.&amp;nbsp; This home required a cash offer as no bank would loan on it!&amp;nbsp;My client the buyer was very fortuante to have been the winner on this home.&amp;nbsp; It did help that I knew the home and the area very well.&amp;nbsp; I had represented the seller on this home several years ago when it sold for almost $700,000!&lt;/P&gt;
&lt;P&gt;So the moral of this story is to hook up an agent and let them know you want to get in on this market before it&amp;nbsp;ends! Don't miss the boat, the&amp;nbsp;boat will not stay in port for ever in this amazing Southern California real estate market.&lt;/P&gt;

However, there need not be any mystery or fear attached to that phrase.&amp;nbsp; With
an experienced professional guiding the process, feelings of trepidation can
quickly turn to excitement and enthusiasm.&lt;/p&gt;

&lt;br /&gt;

&lt;p&gt;While
many terms and conditions may be attached to an offer, the real biggie, of
course, is price.&amp;nbsp; While you may have heard that your offer should be a certain
percentage below the asking price, or even a percentage below what you are
willing to pay, consideration of your offer will always be affected by the laws
of supply and demand. &lt;/p&gt;

&lt;br /&gt;

&lt;p&gt;When
buyers compete, sellers often see full-price offers.&amp;nbsp; However, when inventories
are high and demand is lower, an offer below asking price could be in order.&amp;nbsp;
Typically, your offer will be presented to the seller(s) and/or their
representative(s).&amp;nbsp; The seller may accept or reject the offer, but it's quite
common for the seller to reply with a counter-offer.&lt;/p&gt;

&lt;br /&gt;

&lt;p&gt;Since
it's often not a simple Yes or No answer, it is absolutely critical for you to
stay in close contact with your representative, so that negotiation is handled
smoothly and in a timely manner.&amp;nbsp; Take heart that a counter-offer is not a
rejection.&amp;nbsp; As long as the offer is on the table, you can nearly always
negotiate your way to Yes!&lt;/p&gt;
